Hearing in the case between Muhammad Sani Abacha and four other defendants has further been fixed for the 14th of October 2022 at the Federal High court in Kano.
Defendants in the case are the Independent National Electoral Commission (INEC), the Peoples Democratic Party (PDP), Sadiq Aminu Wali, who is the adopted governorship candidate of the party and Alhaji Shehu Sagagi who was the Peoples Democratic Party (PDP) chairman when the election was conducted.
The judge, Justice A.M. Liman of the Federal High Court I Kano responsed to oral applications by the second, third and forth defendants seeking for extension of time for hearing in the case and fixed the new date.
The plaintiff, Muhammad Abacha was also present at the court when the lead counsel representing him Reuben Ataba SAN addressed newsmen on the court sitting.
“The matter came up today for hearing of the substantive matters but unfortunately the second defendant, the third as well as the forth filed their processes out of time.
“So they applied to court for extension of time within which their processes will be deemed properly filed and served, and by the rules of the court the application was granted.
“More so, we also need time to respond to the issues they have raised, because some of the issues raised are new and there is every need for us to respond to them and we have to respond within a period of three weeks.
“So the matter has now been adjourned to the 14th day of October 2022 for hearing in the substantive matter” he explained.
It would be recalled that on the 25th day of May, PDP primary election took place in Kano and Alhaji Muhammad Sani Abacha emerged winner.
But another person’s name was forwarded to INEC as the party candidate by the PDP in Kano. To this, Abacha’s counsel said they have to seek legal redress.
“We cannot keep quite. So we have to approach the court to determine whether what PDP did was wrong or right.
“So the issue now is a subject matter of litigation before the Federal High Court. I know justice will be done” he declared.
