Bauchi State High Court has issued an interim restraining order against Babayo Aliyu Misau, the suspended state chairman of the All Progressives Congress (APC), preventing him from presenting himself as a member or chairman of the party in the state.

The order was granted by Justice Lamido Umar in a suit filed by Alhaji Al-Mustapha Zubairu with suit number: BA/73/2023.

Justice Umar reviewed the motion ex-parte, the affidavit in support, and the applicant’s written address, which requested an order of interim injunction.

He also considered the exhibits in support of the application, along with the affidavit in support deposed to by Abdulhamid Attahir and the written address of the applicant’s counsel, S.G. Idrees.

In light of the evidence presented, Justice Umar granted the order of interim injunction, restraining Babayo Misau from representing himself as the state chairman of the party or as a member of the APC.

The orders of the court are straightforward.

The first order prohibits Misau from further parading himself as a member of the APC or the chairman of the party in Bauchi State until the determination of the motion on notice.

The second order prohibits the APC from dealing with Misau as a member or chairman of the party pending the determination of the Motion on Notice.

The suit was filed by Alhaji Al-Mustapha Zubairu, a member of the APC in Bauchi State, who sought an interim injunction against Misau.

The plaintiff claimed that Misau was not a validly elected chairman of the party in the state, and that he had been suspended by the National Executive Committee of the APC.
